Unpaid Overtime Claims
The Fair Labor Standards Act (FLSA) requires companies to pay certain employees for all of their hours worked, especially when those hours should be time-and-a-half overtime hours. Unfortunately, many employers routinely violate the FLSA.
Frequently, employers will fail to pay overtime to employees who are entitled to overtime compensation. Sometimes employers do this intentionally, such as by refusing to pay workers when they work through lunch or from home, for travel time, for time worked at the beginning and end of their shift or time worked in excess of 40 hours.
Other times, employers improperly classify employees as “exempt” from the overtime rules. One way employers do this is by classifying certain employees as “managers” despite the fact that their primary job duties are not managerial in nature.
Whether you have been misclassified as “exempt”, or are not being paid overtime for work you have performed, you may be entitled not only to your unpaid wages but to additional damages.
FLSA claims are very complex. The federal regulations, Department of Labor opinion letters and federal appeals cases relating to FLSA would fill hundreds of boxes if printed out. These are not cases that can be trusted to a lawyer who doesn't have a deep understanding and experience in these issues. Our employment lawyer has handled several hundred FLSA cases over his 20 years of practice, and he is ready to put his knowledge and experience to work protecting your rights.
