Types of Misdemeanors

Under Virginia law, misdemeanor criminal offenses are categorized into 4 classes, each with its own range of sentences. Specifically, the four classes of misdemeanors, and the possible sentences are:

  • Class 2: up to 6 months in jail and / or a fine of up to $1,000
  • Class 3: a fine of up to $500
  • Class 4: a fine of up to $250
If Virginia law doesn't specify a specific punishment for a particular misdemeanor, it will be treated as a Class 1 misdemeanor criminal offense.

Virginia Court Procedure

Misdemeanor cases typically begin with an arraignment in General District Court. At the arraignment, the accused is notified of the charges he or she faces. If the crime is a misdemeanor, the court will set a date for a trial where the judge will hear evidence presented by the prosecutor as well as evidence on behalf of the accused.
